What Lovely Day promises, and what it asks of you.

Who we are

Lovely Day is made by Apps People Pty Ltd, in Western Australia. By using it you agree to these terms. If you don’t, please don’t use it. Our privacy policy says what we hold and who sees it.

Using Lovely Day

You must be 18 or over. One account belongs to one person: your funeral wishes, your messages, your keyholders.

Your email address is your key. We sign you in with a code sent to it, so keep it working and keep it to yourself. If you lose access to it, tell us and we’ll help where we safely can.

What Lovely Day is, and isn’t

Lovely Day records what you want to happen and gives it to the right people when you die.

It isn’t a will, and it isn’t legal, financial or funeral advice. Your funeral wishes guide your family and your funeral director; they aren’t legally binding, and they don’t override a will or the law where you die. Anything that must be binding belongs in a will.

Keyholders

You choose the people who can tell us you’ve died. Two of them have to confirm it, we email you and wait 48 hours, and then we share your wishes.

They’re your people, not ours. We can’t make anyone accept, answer, or act quickly, and we can’t promise your wishes will reach your family in time for your funeral. Choose people who will know quickly, keep their details up to date, and tell them they’re a keyholder.

Keyholders are asked not to pass their link on. We can’t stop them.

Your messages

Messages wait until your death has been officially registered and we’ve checked it. A message with a date waits for that date too. Each one goes only to the person it’s for.

We can’t promise an address will still work years from now, or that the person will still be alive to read it.

What you put in

It stays yours. You give us permission to keep it and to share it as you’ve asked us to, with your keyholders, your funeral director and the people you leave messages for, and for no other purpose.

You promise that what you put in is yours to give: your photos and videos, and anything of other people’s you’ve been allowed to use. Songs are links to music services; we don’t supply the music, and playing it at a funeral may need a licence where you live.

Don’t use Lovely Day for anything unlawful, or to threaten or harass anyone. We don’t read what you store, but if we’re told about something serious we may look into it and close the account.

Paying

The free plan lets you write your funeral wishes and the practical things, choose keyholders, and add 10 photos. The paid plan is a one-off payment — in the app through Apple or Google, or on the website through Paddle. There’s nothing more to pay.

It adds messages, 100 photos and a slideshow for the service, 60 minutes of video, 300 minutes of audio and 200 MB of funeral papers. If we change what a plan includes, what you’ve already paid for stays as it was.

Who you buy from depends on where you buy. On the website it’s Paddle.com Market Ltd: your contract for that purchase is with them, and they collect the tax for wherever you live. In the apps it’s Apple and Google, on the same footing.

Our refund policy says when we give your money back, and how to ask. A purchase made in an app is Apple’s or Google’s to refund, under their own rules. If you delete your account, what you paid isn’t refunded; if you come back to Lovely Day, you can restore your purchase instead of paying again.

Deleting your account

You can delete your account in Settings, at any time. It closes at once and everything in it is deleted 7 days later, unless you sign in again before then. Once it’s gone we can’t bring it back, so make a copy first if you want one.

If Lovely Day stops

We mean Lovely Day to outlast us, and we’re making arrangements so a closure could be handled even if the company couldn’t do it. Those arrangements aren’t finished, and we won’t pretend otherwise.

What we do promise: if we decide to close Lovely Day, we’ll tell you by email and in the app at least 90 days before, you’ll be able to download a copy of everything throughout, and we’ll complete what’s already in hand for anyone whose death has been confirmed.

What we can’t promise

We work hard to keep Lovely Day running and your things safe, but no service is perfect. There will be times it’s unavailable, and an email can be delayed or go to junk. We aren’t responsible for a phone, an email account or an internet connection that stops working.

If we let you down, what you can claim from us is limited to what you paid us, except where the law doesn’t allow that limit. In Australia, our goods and services come with guarantees that can’t be excluded under the Australian Consumer Law, and nothing here limits them. Wherever you live, you keep the rights your own consumer law gives you.

Changes to these terms

We may change these terms. When we do we’ll change the date at the top, and if a change matters we’ll email you before it takes effect. If you don’t agree with a change, you can delete your account.

Law

These terms are governed by the law of Western Australia, Australia, and its courts. This doesn’t take away the protection of the law where you live.
